Terms of Use

1  Acceptance of Agreement

These Terms of Use (“Agreement”) govern your access to and use of TreatTheBleed.org and any other websites on which these Terms are posted (collectively, the “Websites”). The Websites are owned and operated by Octapharma Canada Inc. (“Octapharma,” “we,” “us,” or “our”).

By accessing or using any part of the Websites, you acknowledge that you have read, understood, and agree to be bound by this Agreement and all applicable laws and regulations. If you do not agree, you must not access or use the Websites.

Octapharma may revise these Terms at any time without specific notice. The updated Terms will be posted on the Websites. Continued use after updates constitutes acceptance of the revised Terms.

2  Purpose of the Website & Medical Disclaimer

  1. Educational & Informational Use Only. The Websites provide general, unbranded medical information for educational purposes. Nothing on the Websites constitutes medical advice and the content must never be relied upon to diagnose, treat, cure, or prevent any disease.
  2. No Patient–Provider Relationship. Use of the Websites—including interactions with any tools, articles, videos, or downloads—does not create a physician-patient or other healthcare-provider relationship. Always seek the advice of a qualified healthcare professional regarding a specific medical condition or treatment plan.
  3. Local Standards Apply. Clinical practice varies by jurisdiction. Users are responsible for interpreting the material in light of local medical, legal, and ethical standards.

3  Use of the Website

The Websites are intended primarily for healthcare professionals, but may be accessed by others. All content should be assessed in context and is not a substitute for professional judgment.

You agree to use the Websites only for lawful purposes and in accordance with this Agreement. You may not use any device, software, or routine to interfere with the proper working of the Websites or impose an unreasonable load on our infrastructure.

4  Third-Party Content, Views & No Endorsement

  1. Third-Party Contributions. Many articles, data, and multimedia assets are supplied by independent third parties. Their opinions and conclusions are their own and do not necessarily reflect those of Octapharma.
  2. No Endorsement Implied. References to specific products, therapies, clinical guidelines, medical societies, or service providers are for context only. Inclusion on the Websites should not be interpreted as an endorsement, recommendation, certification of safety, or guarantee of efficacy.
  3. Accuracy & Currency. Octapharma makes no representations regarding the accuracy, completeness, or currency of third-party material and assumes no liability for errors or omissions.

5  Copyright & Intellectual-Property Rights

Unless otherwise indicated, all materials on the Websites—including text, graphics, logos, names, and designs (“Information”)—are protected by copyright owned by Octapharma. All rights are reserved.

You may download or print single copies for personal, non-commercial use only. Any other reproduction, distribution, or modification requires prior written consent from Octapharma or the relevant rights holder.

No license or right is granted to you regarding any of Octapharma’s trademarks, logos, or other proprietary material.

6  Links to External Sites

The Websites may contain links to third-party sites. These links are provided solely for convenience. Octapharma does not control, endorse, or accept responsibility for the content or practices of external sites. Accessing any third-party site is at your own risk.

Any links to the Websites must be approved in writing by Octapharma. We reserve the right to revoke such consent at any time.

7  No Warranties

The Information on the Websites is provided “as is,” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Octapharma does not warrant that the Websites will be uninterrupted, secure, or error-free, or that any content is accurate, complete, or current.

8  Limitation of Liability

To the fullest extent permitted by law, Octapharma and its directors, officers, employees, agents, contractors, successors, and assigns shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or other damages arising out of or relating to:

  • Use or performance of the Websites;
  • Delay or inability to use the Websites;
  • Reliance on any Information;
  • Viruses or other harmful components obtained via the Websites.

9  System Integrity & Security

You may not use any device, software, or routine to interfere with the proper working of the Websites. Octapharma does not guarantee that the Websites or emails sent from Octapharma are virus-free. You are responsible for implementing adequate antivirus protections.

10  Privacy Statement

Your use of the Websites is also governed by our Privacy Statement, which is incorporated by reference. The Privacy Statement explains how we collect, use, and safeguard personal information in compliance with Canadian privacy laws, including PIPEDA.

11  Termination of Access

Octapharma may suspend, restrict, or terminate your access to all or any part of the Websites at any time, for any reason, without prior notice.

12  Unlawful Activity & Enforcement

Octapharma reserves the right to investigate suspected violations of this Agreement and to report unlawful activity to law-enforcement authorities, regulators, or other appropriate third parties.

13  Governing Law & Dispute Resolution

This Agreement is governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law principles.

You agree to attempt to resolve any dispute through good-faith discussions with Octapharma. If unresolved, either party may refer the matter to mediation or arbitration in Ontario, unless otherwise agreed. Nothing prevents either party from seeking injunctive or equitable relief.

14  Survival

Sections concerning intellectual property, medical disclaimer, limitation of liability, privacy, dispute resolution, governing law, and indemnity survive termination of this Agreement.
